Explanation of words

Mega Gangnam: is International Investment Joint Stock Company – Mega Gangnam, a company legally established and operating in accordance with Vietnamese law, with Business Registration Certificate 01084802311 issued by the Department of Planning and Investment. Hanoi Investment first issued on October 19, 2018 and subsequent registration changes, headquartered at 105, Tran Quoc Hoan Street, Group 2, Dich Vong Hau Ward, Cau Giay District, City Hanoi Vietnam.
Website: is the website with the address at https://megagangnam.com owned by Mega Gangnam;
Services: means all and any services and products provided by Mega Gangnam and displayed on the Website;
Customer: is any individual or organization that accesses the Website;
Update: means upgrading, updating, replacing, suspending and/or terminating any Service and/or part or all of the Website;
Dispute: means any controversy, dispute, difference, claim arising from or related to the content of these T&C;
Force Majeure Event: means any event beyond the reasonable control of Mega Gangnam and the Customer, including but not limited to natural disasters, fires, floods, earthquakes, accidents, disasters, epidemic restrictions, nuclear or radioactive contamination, war, civil war, insurrection, strike or riot, illegal third party intrusion into technical systems and equipment of Mega Gangnam, widespread power grid failure, widespread internet failure;
Party: is Mega Gangnam or Customer depending on the context;
Parties: are both Mega Gangnam and the Customer;
Personal information: Is information associated with determining the identity and personal identity of an individual including name, age, address, identity card number, phone number, email address and other information. according to regulations of the Law;
Cookies: are files a website sends to a user’s computer and are saved through the browser when the user visits that website. Cookies are used to remember status information and remember user activities while accessing and browsing a website. Cookies are also used to save other information that users enter or fill in on the website such as name, address, password, etc.
Customer Data: means all and any information related to the Customer (including Cookies, personal information, payment information) that the Customer provides to Mega Gangnam or that Mega Gangnam obtains in The process of Customers accessing, using the Service, and conducting transactions related to the Website.

Scope of application

These Terms and Conditions will apply to all Customers when accessing the Website and/or conducting any transactions related to the Website.

Customer Obligations

During the process of accessing and using the Website, Customers must comply with the following obligations:

Compliance principles

When accessing and using the Website, Customers must comply with the regulations and instructions of Mega Gangnam. Mega Gangnam will not be responsible for damages or losses of the Customer and/or any other third party unless these damages or losses are caused by Mega Gangnam’s intentional fault.

Illegal operation:

Customers are not allowed to perform any of the following activities on the Website:

Use, copy, edit, reproduce, connect to, create new products or derivative versions based on the Website or build a mirror website to publish information related to the Website. Website;
Redesign, translate, change, disassemble, or reverse engineer Website design or content;
Change or cancel the original state of the Website;
Log in and use the Website using another software or intermediary system without being authorized or approved by Mega Gangnam;
Use Website information to provide services that are the same or similar or substantially similar to the Services;
Batch download or create high volume feeds of Website content.
- Unauthorized use

Customers may not use the Website, the Services or any other services integrated with the Website to commit any illegal acts, for any illegal purposes, including but not limited to in the following actions:

Posting, propagating, or storing information that sabotages and distorts the Government, institutions, and State policies, incites violence, propagates war, causes conflicts between peoples and countries, or activities calling for riots and other protests;
Using the Website to propagate social evils, superstitions, incite lewdness, debauchery, crime, and destroy the nation’s fine customs and traditions;
Do any act that compromises the network security of any Product, including but not limited to using data or accessing system servers or accounts without permission ; access the network system to delete, edit and add information, spread harmful programs, viruses or take any action to harm the network system;
Post, transmit or store any content or images that violate the intellectual property rights, trade secrets, or other legal rights of a third party;
Disseminating journalistic works, literature, art, music, movies, and publications in violation of the law.
Other obligations stipulated in this T&C and according to the provisions of law.

Indemnify

Customer agrees that Customer will hold Mega Gangnam and its subsidiaries, affiliated companies, management personnel, directors, members, employees, attorneys and agents harmless from harmless from any and all claims, costs, damages, losses, liabilities and expenses (including attorney’s fees and other expenses) arising out of or in connection with:

Customer’s use of the Service and/or Website in Customer’s own transactions.
Customer’s breach or violation of any TOS or related regulations or laws, whether or not referred to in these TOS.
Customer’s misuse of the Service and/or Website.

Limitation of liability
- Mega Gangnam makes no representations, warranties or guarantees regarding any of the following:
- About the time, quality, suitability, availability, accuracy or completeness of the Services and Website;
- The Services will meet the Customer’s requirements and expectations;
- Use of the Service will be secure, timely, uninterrupted or error-free or operate in conjunction with any other hardware, software, system or data;
- Errors or omissions on the Website will be corrected;
- The Website or the server that maintains the Website are not infected with viruses or other harmful components
- All conditions, representations and warranties, whether express, implied, statutory or otherwise, including, without limitation, any implied warranty of commercial purposes, fitness for a particular purpose, or non-infringement of third party rights, are excluded to the maximum extent permitted by Vietnamese law.
- The Services and Website may be subject to limitations and potential inherent in the use of the internet and electronic communications, including equipment used by the Customer that is faulty, not connected, or out of range. Cell phone coverage or not working correctly. Mega Gangnam is exempt from all liability if Mega Gangnam’s technical system does not ensure operation in the event of Force Majeure Events.
- Mega Gangnam may provide links or references to other sites on the Internet operated by third parties, solely as a convenience to Customers. Mega Gangnam is not responsible for the content of other sites and therefore accepts no liability for any damages or losses arising from or in connection with the contents of sites linked in any way. Which formula?
- Mega Gangnam is not responsible for resolving any cases, including but not limited to fake Services, used Services, unused Services, that Customers purchase from intermediaries.
- Mega Gangnam will not be responsible for any agreements, disputes, or complaints between the Customer owning the Company Account and the Customer owning the Employee Account.

Intellectual property rights

All intellectual property rights related to the Website (including but not limited to source code, images, data, information, content contained in the Website) and related instructional documents (if any) will be solely owned by Mega Gangnam.
Customers are not allowed to copy, reproduce, distribute or perform other similar acts to infringe Mega Gangnam’s intellectual property rights without Mega Gangnam’s written consent.
Although giving the right to use the Service to the Customer, Mega Gangnam reserves all ownership rights and intellectual property rights of Mega Gangnam with respect to the Service, Website and Products.

Information security

During the process of Customers using the Website and Services, Mega Gangnam may collect and use Customer Data for the ultimate purpose of serving the interests of Customers and providing Customers with the best experiences.
Mega Gangnam views information as an asset that must be protected and uses many tools (encryption, passwords, physical security…) to protect Customers’ personal information from unauthorized access and disclosure. .
Mega Gangnam always strives to secure Customer Data to prevent leaks, theft of personal information, unauthorized use and account access. In addition, Mega Gangnam also deploys and applies information security measures within the framework of cybersecurity standards developed by Mega Gangnam.
Please carefully read the terms and conditions in the Privacy Policy before Customers perform any activities within the Website and/or Products.

Other terms

Mega Gangnam reserves the right to update at any time, and will not be responsible in case the Customer may not be able to use or not fully use part or all of the Website during this update process. .
Mega Gangnam is not responsible for releasing the Services or features of the Services with test versions which may not be accurate or completely identical to the final version. Mega Gangnam has the sole right to limit certain features or the scope of Customer’s access to part or all of Mega Gangnam’s Website or Services without notice or liability.
These T&C and all other regulations, policies, conditions and terms referred to and/or referenced in these T&C shall constitute the entire TOS to which Customer is bound. During the use of the Website and/or Services, the Customer may be required to comply with the specific terms and conditions of a specific service related to the Website and/or other Products. In case of any discrepancy between these Terms and Conditions and the terms and conditions of that other service/Product, the terms and conditions of the other service/Product will prevail.
These T&C can be written in many different languages. In case of conflicts or inconsistencies between languages, the Vietnamese version will prevail.
These Terms and Conditions are prepared, adjusted and interpreted in accordance with the provisions of Vietnamese law. All Disputes (if any) will first be resolved through negotiation in the spirit of good faith cooperation within 30 (thirty) days. If it cannot be resolved within this time limit, Mega Gangnam and/or the Customer may bring the Dispute to be resolved at a competent court in Hanoi in accordance with the provisions of law.
